    Respected Sir,

    With reference to the subject cited above, first of all I am thanking you for your response towards my complain and at the same time being highly unsatisfied with the inspection report of the site inspected on 04.05.2023 by local authorities of your Tinsukia offices, I am explaining herein some facts which would cast doubt over the said inspection report.

    1, That, the facts mention in point no 1 of the inspection report is not correct and the explanation which cast doubt over it are as follows: –

    i. It is a fact that at the time of site inspection, officers found machine at the inspection site which is situated in the municipal area but the question arises herein that why the machines were kept in the said inspected site when the loans were passed for the site situated at Rongpuria Gaon Panchayat.

    ii. As the machines were found in the said inspected site with no sign of production at the unit but another question arises here in that how the alleged unit which is situated at Rongpuria Gaon panchayat (in the name of Geedee Spices & Food Industry with product name Best Masala) is functioning producing and running if the machines are kept at the inspected site which is situated in Municipal area.

    iii. In the inspection report is stated that there was no electric connection in the room to run the machine but if the inspection would made with due sincerity officers would surely notice that the inspected room was situated in the house of the said PMEGP loan borrowers which have electric connection in the house and from there required no time to equipped the said inspected room with temporally electric connection.

    iv. Then and again the matter of running an illegal spice Grinding industry had been brought to the notice of the authorities of DICC Tinsukia but they have never tried to visit inspect the unit allegedly running in the Rongpuria Gaon Panchayat on which PMEGP loan was avail to bring into light exact location of the illegal unit. From the above explanatory facts, it is clean enough that Geedee Spices & Food Industry with product name Best Masala is not running in Rongpuria Gaon Panchayat for which PMEGP loan was obtained by showing Rongpuria Gaon Panchayat Trade License instead the unit is running in ward no 15 of Tinsukia Municipal Board further, It is also clear enough that there in only one single unit on which two different PMEGP loan were obtained.

    2, That, from the facts mention in point no 2 of the inspection report it is found there by the officers that the PMEGP loan was obtained by married couple which is illegal in this respect I would to bring in your notice following facts: –
    i. It is stated that due to ignorance the married couple obtained a PMEGP loan, but in our legal system there is no excuse for ignorance of law. The act of obtaining a loan by a married couple is illegal and is clearly ignorance of law. Since from the above facts it has come into light that the PMEGP loan was Fraudulently obtained by showing place of business/unit at Gaon Panchayat, instead of fact that place of business/unit is under Municipal area,as such there is every possibility that couple had knowingly and deliberately had obtained two PMEGP loan by their fraudulent act.
    ii. That without proper verification of PMEGP loan cannot be passed but inspite of fact that (a) there is no Geedee spices & food industry unit in Rongpuria Gaon Panchayat, (b) loan borrowers are of same family, (c)two different loans on same unit project in two consecutive years, how the said two loans had been passed.
    From the aforesaid explanatory facts, it is clear that Quamruzzaman Ansari and his wife Shahnaz Khatoon had fraudulently obtained PMEGP loan and thereby cheated yourself, Union Bank of India and Punjab & Sind Bank.
    As such, I request you to initiate an enquiry at Executive Magistrate level and take legal action against the culprits.
